Homelessness

Under the Act you are homeless if you:

  • have no accommodation in the United Kingdom or elsewhere that you are legally entitled to occupy
  • have accommodation but:
  • cannot get into it because, for example, you have become illegally evicted
  • are liable to threats of, or actual violence, from someone living there
  • it is not reasonable for you to continue living there
  • have moveable accommodation like a caravan or a boat, but have nowhere to place it and live in it

You are considered as threatened with homelessness if you are likely to become homeless within 28 days.

In general you will not be eligible if:-

You are a person from abroad and subject to immigration control, except for some Asylum Seekers.
There are some exceptions. If you are uncertain please seek advice from your local council.

If you think you may lose your present home, get advice immediately. You should not leave your present home whilst you have a right to remain there.
We will only help if we are satisfied that you have become homeless through no fault of your own.
We may decide you have made yourself intentionally homeless if:-

  • you have given up accommodation which you could reasonably have continued to occupy, or
  • you have lost accommodation through your own fault
