Generally it is women who are abused by men but it can equally apply to men abused by women or to gay and lesbian relationships. It is not considered reasonable to expect you to continue to occupy a property if you have been the victim of domestic violence from a person who normally lives with you as a member of your family or any other person. What will the Council do for anyone experiencing Domestic Violence?We will treat all enquiries confidentially The Housing Needs Section will respond quickly to any complaints of Domestic Violence. You will be treated with courtesy and sensitivity and will be offered a private interview. You will not be asked to provide evidence of physical, mental or sexual abuse at the initial interview. The Council will, however, carry out any necessary investigation but you will not be required to provide supporting evidence before advice, support or emergency accommodation, where needed, has been provided We will not make enquiries without your permission. We will not contact the perpetrator or their family without your consent. We will only disclose information with your consent or where necessary as in the case of a Court Order or under Child Protection procedures. You will not be expected to remain in, or return to, accommodation which is considered to be unsafe What happens if you want to take legal action?If you decide to take legal action against the person accused of domestic violence we will give you appropriate advice. This action could include obtaining an injunction and/or an ouster order. Where will you stay?If you are experiencing domestic violence, we will ensure that you have access to emergency accommodation, regardless of whether you are renting from the Council, a private landlord or are an owner occupier. The long term solution may be different depending upon your type of tenancy/tenure. Wherever possible we will assist you to return to your own home provided we are satisfied you would not be at risk.
