Environmental Permitting Licences

Information for businesses and operations who require licenses under the Environmental Permitting Regulations.

Who Should Apply

If you are responsible for an industrial installation controlled under the Environmental Permitting Regulations 2007 then you must apply for a permit to operate . A guide is available to Environmental permitting regulations and the installation types covered by this legislation.

Local authorities are responsible for permitting and regulating Part B and Part A2 installations. Part B installations are regulated for their emissions to air only, Part A2 installations require controls to ensure the protection of the environment from emissions to air, land and water (including discharges to sewer).

A current list of all the permitted installations in Lewes district is provided. The larger Part A1 installations are regulated by the Environment Agency.

Fees

If an installation is required to apply for and to maintain a permit then a risk-based fee and annual charge is levied. This scheme is designed so that industry pays reasonable costs to the local authorities who regulate them under the "polluter pays" principle.

Ultimately the greater the risk to the environment, the higher the risk banding the installation will fall into, and the greater the fees payable.

This "risk method" is applied giving a risk rating (low, medium or high) to each industrial installation dependent upon a variety of factors such as the inherent risk of the activity to the environment, operator performance, and the (reasonable) time taken by the regulating officers to carry out their work. These charges are set by the Secretary of State after consultation.

Application Process

On receipt of an application we consider it to be duly made unless further information is required.  Following this your application will be placed on the public register and be open to consultation.  The timescale for this can be up to four months.  You will be notified of the determination and a permit issued to you, if successful.

Appeals

If your application is unsuccessful or you disagree with any permit conditions applied, you may appeal.  In the first instance contact us direct for guidance on the appeals process.
